Verizon Wireless insurance policy help?

My mom’s Palm Pre broke and, since they no longer make that phone, she was sent an upgraded device… Well the phone she was sent was the one that I wanted to get when we switched in October. I used to have an iPhone 4 but had to sell it after we switched (wasn’t a sure thing at that point) and since I wasn’t working at the time (seasonal job that I had when I purchased my iPhone) I had to settle for a free device. I didn’t want to have my mom pay a lot of money for it… anyway, she had to pay 89 dollars for a replacement device upgrade and I offered to let her have my phone (that she said she liked) in trade for me paying her 95-100 dollars for the replacement she was sent. I was mainly wondering if it was possible for me to use that phone or if it would be considered fraud since the phone was used for a replacement on her line and Verizon isn’t a GSM carrier so phones need to be activated to a certain line.

ask verizon if you can switch phones and keep the same numbers
It would mean reactivating each phone to the correct line
but they might do it
